Gesetz zu dem Abkommen vom 18. April 1966 zwischen der Bundesrepublik Deutschland und dem Königreich Griechenland zur Vermeidung der Doppelbesteuerung und zur Verhinderung der Steuerverkürzung bei den Steuern vom Einkommen und vom Vermögen sowie bei der Gewerbesteuer 852 Bundesgesetzblatt, Jahrgang 1967, Teil II Gesetz zu dem Abkommen vom 18. Februar 1967 Der Bundestag hat mit Zustimmung des Bundesrates das folgende Gesetz beschlossen: Artikel 1 Dom in Athen am 18. April 1966 unterzeichneten Abkommen zwischen der Bundesrepublik Deutschland und dem Königreich Griet henand zur Vermeidung der Doppelbesteuerung und zur Verhinderung der SteutM Verkürzung bei den Steuern vom Einkommen und vom Vermögen sowie bei der Ge-wei besteuer wird zugestimmt. Das Abkommen wird nachstehend veröfientlicht. Artikel 2 |1J Die Verordnung zur Beseitigung \:on Doppelbesteuerungen auf dem Gebiet der direkten Steuern im Verhältnis zu Griechenland vom 15. Juni 1944 (Reichsgesetzbl. II S. 47) wird mit Wirkung vom Inkrafttreten des Abkommens an aufgehoben. Die Verordnung ist letztmals auf Steuern anzuwenden, die für das Kalenderjahr 1963 erhoben weiden. (2) Soweit sich auf Grund des Absatzes 1 Satz 2 dieses Artikels oder auf Grund des Artikels XXIII Abs. 2 des Abkommens für die Zeil bis zum Beginn des Jahres, in dem das Abkommen in Kraft tritt, bei der jeweiligen Sleuerart insgesamt eine höhere Belastung ergibt, als sie nach den Rechtsvorschriften vor Inkrafttreten des Abkommens bestand, wird der Steuermehrbetrag nicht erhoben. Artikel 3 Dieses Gesetz gilt ciuch im Land Berlin, sotern das Land Berlin die Anwendung dieses Gesetzes feststellt. Artikel 4 (1) Dieses Gesetz tritt am Tage seiner Veikun-dung in Kralt. (2) Der Tag, an dem das Abkommen nach seinem Artikel XXIII Abs. 2 in Kralt tritt, ist im Bundesgesetzblatt bekanntzugeben. Das vorstehende Gesetz wird hiermit verkündet. Bonn, den 18. A r 11 c 1 e I (1) The taxes which are the subject of this Agreement are: 1. in the Föderal Republic of Gcr-many: the Einkommensteuer (mcome tax), the Körporschaftsleuer (corporation tax), the Vermögensteuer (capital tax) and the Gewerbesteuer (trade tax) (hereinafter refened to as "Föderal Republic tax"); 2. in the Kingdom of Greece: the income tax on natural persons (Einkommensteuer der natürlichen Personen) and the income tax on legal persons (Einkommensteuer der juristischen Personen) (hereinafter refened to as "Greek tax"). (2) This Agreement shall also ap-ply to any identical or substantially similar taxes which are subsequently imposed in addition to, or in place of the existing taxes. Artikel 11 (1) Soweit der Zusammenhang nichts anderes erfordert, gilt für dieses Abkommen folgendes: 1. Der Ausdruck "Steuer" bedeutet je nach dem Zusammenhang die deutsche Steuer oder die griechische Steuer. 2. Der Ausdruck "Person" umfaßt natürliche Personen und Gesellschaften. 3. Der Ausdruck "Gesellschaft" bedeutet eine juristische Person oder einen anderen Rechtsträger, der nach dem Recht der Bundesrepublik Deutschland steuerlich als juristische Person behandelt wird, und einen nach dem Recht des Königreichs Griechenland errichteten Rechtsträger. 4 (a) Der Ausdruck "eine in einem Yertragstaat ansässige Person" bezeichnet eine Person, die nach dem Recht dieses Staates dort auf Grund ihres Wohnsitzes, ihres ständigen Aufenthaltes, des Ortes ihrer Geschäftsleitung oder eines anderen ähnlichen Merkmals steuerpflichtig ist. The form "tax" means Fedeial Republic tax or Greek tax, as the c ontext recjuires. 2. The term "peison" includes indi-viduals and companies. 3. The term "Company" means any body corporate, any entity which is treated as a body corporate for tax puiposes under the laws of the Federal Republic of Germany and any legal entity established under the laws of the Kingdom of Greece. 4 la) The term "resident of a Contracting State" means any peison who, under the law of (hat State, is hable to taxation therein by reason of bis domi-cile, residence, place of man-aqement or any other similar < riterion. (dd) Besitzt die Person die Staatsangehörigkeit beider Vertragstaaten oder keines Vertragstaates, so regeln die zuständigen Behörden der Vertragstaaten die Frage in gegenseitigem Einvernehmen. (c) Ist nach Buchstabe (a) eine Gesellschaft in beiden Vertragstaaten ansässig, so gilt sie als in dem Vertragstaat ansässig, in dem sich der Ort ihrer tatsächlichen Geschäftsleitung befindet. Dasselbe gilt für Per-sonenyesellschaften und andere Personenvereinigungen, die nach den für sie maßgebenden innerstaatlichen Gesetzen keine juristischen Personen sind. Der Ausdruck "deutsches Unternehmen" bezeichnet ein gewerbliches Unternehmen, das von einer in der Bundesrepublik Deutschland ansässigen Person betrieben wird, und der Ausdruck "griechisches Unternehmen" ein gewerbliches Unternehmen, das von einer im Königreich Griechenland ansässigen Person betrieben wird; die Ausdrücke "Unternehmen eines Veitragstaates" und "Unternehmen des anderen Vertragstaates" bezeichnen je nach dem Zusammenhang ein deutsches oder ein griechisches Unternehmen. Artikel IX (1) Gewinne, die eine in einem Vertragstaat ansässige Person aus dem Verkauf, der Übertragung oder dem Tausch von Vermögenswerten aus Quellen innerhalb des anderen Vertragstaates bezieht, können nur in dem erstgenannten Staate besteuert werden. (2) Absatz 1 ist nicht anzuwenden, wenn eine in einem Vertragstaat ansässige Person in dem anderen Vertragstaat durch eine dort gelegene Be-triebstälte gewerblich tätig ist und die Gewinne dieser Betriebstätte zuzurechnen sind; in diesem Fall ist Artikel III anzuwenden. (4) Where, owing to a special re-lationship between the payer and the recipient or between both of them and some other person, the amount of the royalties paid, having regard to the use, right or information for which they are paid, exceeds the amount which would have been agreed upon by the payer and the recipient in the absence of such relationship, the provisions of this Article shall apply only to the last-mentioned amount. In that case, the excess part of the payments shall remain taxable aecording to the law of each Contracting State, due regard being had to the other provisions of this Agreement. Article IX (1) Gains from the sale, transfer or exchange of capital assets derived by a resident of a Contracting State from sources within the other Contracting State shall be taxable only in the iirst-mentioned State. (2) Paragraph (1) shall not apply where a resident of a Contracting State carries on a trade or business in the other Contracting State through a permanent establishment situated Hierein and such gains are attributable to that permanent establishment; in such event Article III of this Agreement shall be applicable. (2) Remuneration in respect of pres-ent Services paid out of public funds of the Federal Republic of Germany or its Länder or political sub-divisions thereof shall be taxable only in that State unless the payment is made to a national of the Kingdom of Greece who is not also a German national. (3) The provisions of paragraphs (1) and (2) shall not apply to remunera-tions in respect of Services in connec-tion with any trade or business carried on by either of the Contracting States or political sub-divisions thereof for purposes of protit. Artikel XVII (1) Bei einer im Königreich Griechenland ansässigen Person wird die Steuer wie folgt festgesetzt: Vorbehaltlich der Vorschritten des griechischen Einkommensteuerrechts wird die deutsche Steuer, die nach den Gesetzen der Bundesrepublik Deutschland und nach Maßgabe dieses Abkommens entweder unmittelbar oder im Abzuqsweg von den Einkünften aus Quellen innerhalb der Bundesrepublik Deutschland erhoben wird, auf die von diesen Einkünften zu entrichtende griechische Steuer angerechnet. (2) Bei einet in der Bundesrepublik Deutschland ansässigen Person wird die Steuer wie folgt festgesetzt: 1. Von der Bemessungsgruncllage der deutschen Steuer werden die Ein-künite aus Quellen innerhalb des Königreichs Griechenland und die innerhalb des Königreichs Griechenland gelegenen Vermögenswerte ausgenommen, die nach Maßgabe dieses Abkommens im Königreich Griechenland besteuert werden können, es sei denn, daß Nummer 2 gilt. Werden ihre Einwendungen als begründet erachtet, so wird sich die zuständige Behörde des angerufenen Staates mit der zuständigen Behörde des anderen Staates über die Vermeidung der Doppelbesteuerung zu verstandigen suchen. A r t i c 1 e XX (1) Where a resident of a Contracting State shows proof that the action of the tax authorities of the Contracting States has resulted or will result in double taxation contrary to the provisions of this Agreement he shall be entitled to present his case to the State of which he is resident. Should his claim be deemed worthy of con-sideration, the competent authority of the State to which the claim is made shall endeavour to come to an Agreement with the competent authority ol the other State with a view to avoid-ance of double taxation.
