zu den Protokollen Nr. 2, 3 und 5 zur Konvention
zum Schutze der Menschenrechte und Grundfreiheiten
Vom 10. Dezember 1968
Der Bundestag hat dcis folgende Gesetz beschlossen:
Artikel 1
Dem in Strasburg am 6. Mai 1963 von der Bundesrepublik Deutschland unterzeichneten Protokoll Nr. 2 zur Konvention zum Schutze der Menschenrechte und Grundfreiheiten, durch das dem Europäischen Gerichtshof für Menschenrechte die Zuständigkeit zur Erstattung von Gutachten übertragen wird,
dein in Straßbuig am G. Mai 1963 von der Bundesrepublik Deutschlund unterzeichneten Protokoll Nr. 3 zur Konvention zum Schutze der Menschenrechte und Grund! reihcilen, durch das die Artikel 29, 30 und 34 der Konvention geändert werden, sowie
dem in Straßbuig am 3. März 1966 von der Bundesrepublik Deutschland unterzeichneten Protokoll Nr. 5 zur Konvention zum Schutze der Menschen-
rechte und Grundfreiheilen, durch das die Artikel 22 und 40 der Konvention geändert werden,
wird zugestimmt. Die Protokolle werden nachstehend veröffentlicht.
Artikel 2
Dieses Gesetz gilt auch im Land Beilin, sofern das Land Berlin die Anwendung dieses Gesetzes feststellt.
Artikel 3
(1) Dieses Gesetz tritt am Tage nach seiner Verkündung in Kraft.
(2) Die Tage, an denen das Protokoll Nr. 2 nach seinem Artikel 5 Abs. 2, das Protokoll Nr. 3 nach seinem Artikel 4 Abs. 2 und das Protokoll Nr. 5 nach seinem Artikel 5 Abs. 2 in Kraft treten, sind im Bundesgesetzblatt bekanntzugeben.
Die verfassungsmäßigen Rechte des Bundesrates sind gewahrt.
Das vorstehende Gesetz wird hiermit verkündet.

THE MEMBER STATES OF THE COUNCIL OF EUROPE signatory hereto:
HAVING REGARD to the provisions of the Convention for the Protection of Human Rights and Fundamental Freedoms signed at Rome on 4th November 1950 (hereinafter referred to as "the Convention") and, in partic-ular, Article 19 instituting, among other bodies, a European Court of Human Rights (hereinafter referred to as "the Court");
CONSIDERING that it is expedient to confer upon the Court competence to give advisory opinions subject to ceitain conditions,-
HA VE AGREED AS FOLLOWS:
Article 1
1. The Court may, at the request of the Committee of Ministers, give advisory opinions on legal questions conccrning the interpretation of the Convention and the Protocols thereto.
2. Such opinions shall not deal with any qucstion rclating to the content or scope of the rights or freedoms defined in Section 1 ot the Convention and in the Protocols thereto, or with any other queslion which the Com-mission, the Court or the Committee of Ministers might have to consider in consequence of any such proceed-ings as could be instituted in accord-ance with the Convention.

CONSIDERANT quil est opportun dattribuer ä la Cour la competence de donner, sous certaines conditions, des avis consultatifs,
SONT CONVENUS DE CE QUI SUIT:
Article 1er
1. La Cour peut, ä la demande du Comite des Ministres, donner des avis consultatifs sur des questions juridi-ques concernant linterpretation de la Convention et de ses Protocoles.
2. Ces avis ne peuvent porter sur les cjuestions ayant trait au contenu ou a letendue des droits et libertes definis au titre 1er de la Convention et dans ses Protocoles, ni sur les autres questions dont la Commission, la Cour ou le Comite des Ministres pourraient avoir ä connaitre par suite de Iintroduction dun recours prevu par la Convention.

DIE MITGLIEDSTAATEN DES EUROPARATS, die dieses Protokoll unterzeichnen –
IM HINBLICK auf die Bestimmungen der am 4. November 1950 in Rom unterzeichneten Konvention zum Schutze der Menschenrechte und Grundireiheiten (im folgenden als "Konvention" bezeichnet), insbesondere auf ihren Artikel 19, durch den neben anderen Organen ein Europäischer Gerichtshof tut Menschenrechte (im folgenden als "Gerichtshof" bezeichnet) errichtet wird,
IN DER ERWÄGUNG, daß es angebracht ist, dem Gerichtshof die Zuständigkeit zu übertragen, unter bestimmten Bedingungen Gutachten zu erstatten –
HABEN FOLGENDES VEREINBART:
Artikel 1
(1) Der Gerichtshot kann auf Antrag des Ministerkomitees Gutachten über Rechtsfragen betreifend die Auslegung der Konvention und der dazugehörigen Protokolle erstalten.
(2) Diese Gutachten dürfen keine Fragen zum Gegenstand haben, die sich auf den Inhalt oder das Ausmaß der in Abschnitt I der Konvention und in den dazugehörigen Protokollen bezeichneten Rechte und Freiheiten beziehen, noch dürfen sie andere Fragen betreuen, über die die Kommission, der Gerichtshof oder das Ministerkomitee auf Grund eines nach der Konvention eingeleiteten Verfahrens zu entscheiden haben könnte.

3. Decisions of the Committee of Ministers to request an advisory opin-ion of the Court shall require a two-thirds majority vote of the represent-atives entitled to sit on the Committee.
Article 2
The Court shall decide whether a request for an advisory opinion sub-mitted by the Committee of Ministers is within its consultative competence as defined in Article 1 of this Protocol.
Article 3
1. For the consideration of requests for an advisory opinion, the Court shall sit in plenary session.
2. Reasons shall be given for advisory opinions of the Court.
3. If the advisory opinion does not represent in whole or in part the unanimous opinion of the judges, any judge shall be entitled to deliver a separate opinion.
4. Advisory opinions of the Court shall be communicated to the Committee of Ministers.
Article 4
The powers of the Court under Article 55 of the Convention shall extend to the drawing up of such rules and the determination of such procedure as the Court may think necessary for the purposes of this Protocol.
Article 5
1. This Protocol shall be open to Signatare by member States of the Council of Europe, signatories to the Convention, who may become Parties to it by:
(a) signature vvithout reservation in respect of ratification or accept-ance,-
(b) signature with reservation in respect of ratification or acceptance, followed by ratification or acceptance.
Instruments of ratification or acceptance shall be deposited with the Secretary-General of the Council of Europe.
2. This Protocol shall enter into force as soon as all States Parties to the Convention shall have become Parties to the Protocol, in accordance with the provisions of paragraph 1 of this Article.
3. From the date of the entry into force of this Protocol, Article 1 to 4 shall be considered an integral part of the Convention.

Article 2
La Cour decide si la demande da-vis presentee par le Comite des Mi-nistres releve de sa competence consultative teile que celle-ci est definie par larticle 1er du present Protocole.
Article 3
1. Pour lexamen des demandes da-vis consultatifs, la Cour siege en seance pleniere.
2. Lavis de la Cour est motive.
3. Si lavis nexprime pas en tout ou en partie lopinion unanime des juges, tout juge a le droit dy joindre lex-pose de son opinion individuelle.
4. Lavis de la Cour est transmis au Comite des Ministres.
Article 4
Par extcnsion du pouvoir que lui attribue larticle 55 de la Convention et aux fins du present Protocole, la Cour peut, si eile lestime necessaire, etablir son reglement et fixer sa procedure.
Article 5
1. Le present Protocole est ouvert ä la signature des Etats membres du Conseil de lEurope signataires de la Convention, qui peuvent y devenir Parties par:
(a) la signature sans reserve de ratification ou dacceptation;
(b) la signature sous reserve de ratification ou dacceptation, suivie de ratification ou dacceptation.
Les instruments de ratification ou dacceptation seront deposes pres le Secretaire General du Conseil de lEurope.
2. Le present Protocole entrera en vigueur des que tous les Etats Parties ä la Convention seront devenus Parties au Protocole, conformement aux dispositions du paragraphe ler de cet article.
3. A dater de lentree en vigueur du present Protocole, les articles 1er ä 4 seront consideres comme faisant partie integrante de la Convention.
(3) Beschlüsse des Ministerkomitees, ein Gutachten beim Gerichtshof zu beantragen, bedürfen einer Zweidrittelmehrheit der zur Teilnahme der an den Sitzungen des Komitees berechtigten Mitglieder.
Artikel 2
Dei Gerichtshof entscheidet, ob ein vom Ministerkomitee gestellter Antrag auf Erstattung eines Gutachtens unter seine in Artikel 1 bezeichnete Zuständigkeit fallt.
Artikel 3
(1) Anträge auf Erstattung eines Gutachtens werden vom Plenum des Gerichtshofs behandelt.
(2) Die Gutachten des Gerichtshofs sind zu begründen.
(3) Bringt das Gutachten im ganzen oder in einzelnen Teilen nicht die übereinstimmende Ansicht der Richter zum Ausdruck, so hat jeder Richter das Recht, eine Darstellung seiner eigenen Ansicht beizufügen.
(4) Die Gutachten des Gerichtshofs werden dem Ministerkomitee übermittelt.
Artikel 4
Der Gerichtshof kann in Erweiterung seiner in Artikel 55 der Konvention vorgesehenen Befugnis die Geschäfts-ordnungs- und Verfahrensbestimmungen festlegen, die er für die Zwecke. dieses Protokolls für erforderlich halt.
Artikel 5
(1) Dieses Protokoll liegt für die Mitgliedstaaten des Europaiats, die die Konvention unterzeichnet haben, zur Unterzeichnung auf; sie können Vertragsparteien des Protokolls werden,
a) indem sie es ohne Vorbehalt der Ratifikation oder Annahme unterzeichnen oder
b) indem sie es unter dem Vorbehalt der Ratifikation oder Annahme unterzeichnen und später ratifizieren oder annehmen.
Die Ratifikations- oder Annahmeurkunden sind beim Generalsekretär des Europarats zu hinterlegen.
(2) Dieses Protokoll tritt in Kraft, sobald alle Vertragsstaaten der Konvention nach Absatz 1 dieses Artikels Vertragsparteien des Protokolls geworden sind.
(3) Vom Tag des Inkrafttretens dieses Protokolls an gelten die Artikel 1 bis 4 als Bestandteil der Konvention.

4. The Secretary-General of the Council of Europe shall notify the member States of the Council of:
(a) any signature without reservation in respect of ratification or accept-ance;
(b) any signature with reservation in respect of ratification or accept-ance;
(c) the deposit of any Instrument of ratification or acceptance;
(d) the date of entry into force of this Protocol in accordance with para-graph 2 of this Article.
IN WITNESS WHEREOF, the under-signed, being duly authorised thereto, have signed this Protocol.
DONE at Strasbourg, this 6th day of May 1963, in English and in French, both texts being equally authoritative, in a Single copy which shall remain deposited in the archives of the Council of Europe. The Secretary-General shall transmit certified copies to each of the signatory States.

THE MEMBER STATES OF THE COUNCIL OF EUROPE, signatories to this Protocol,
CONSIDER1NG that it is advisable to amend certain provisions of the Convention for the Protection of Human Rights and Fundamental Freedoms signed at Rome on 4th November 1950 (hereinafter referred to as "the Convention") concerning the pro-cedure of the European Commission of Human Rights,
HAVE AGREED AS FOLLOWS:
A r t i c 1 e 1
1. Article 29 of the Convention is deleted.
2. The follovving provision shall be inserted in the Convention:
"Article 29
After it has accepted a petition submitted under Article 25, the Commission may nevertheless decide unanimously to reject the petition if, in the course of its examination, it finds that the ex-istence of one of the grounds for non-acceptance provided for in Article 27 has been established.
In such a case, the decision shall be communicated to the parties."
Article 2
In Article 30 of the Convention, the word "Sub-Commission" shall be re-placcd by the word "Commission".

SONT CONVENUS DE CE QUI SUIT:
Article 1"
1. Larticle 29 de la Convention est supprime.
2. La disposition suivante est inse-ree dans la Convention:
< Article 29
Apres avoir retenu une requete introduite par application de larticle 25, la Commission peut neanmoins decider ä lunanimite de la rejeter si, en cours dexa-men, eile constate lexistence dun des motifs de non recevabilite prevus ä larticle 27.
En pareil cas, la decision est communiquee aux parties. »
Article 2
A larticle 30 de la Convention, le mot « sous-commission » est remplace par le mot « Commission ».

(2) In die Konvention wird folgende Bestimmung eingefügt:
"Artikel 29
Die Kommission kann jedoch ein ihr gemäß Artikel 25 unterbreitetes Gesuch durch einstimmigen Beschluß auch nach der Annahme zurückweisen, wenn sie bei der Prüfung des Gesuchs feststellt, daß einer der in Artikel 27 bezeichneten Gründe für eine Unzulässigkeit vorliegt.
In diesem Fall wird die Entscheidung den Parteien mitgeteilt."
Artikel 2
In Artikel 30 der Konvention wird das Wort "Unterkommission" durch das Wort ..Kommission" ersetzt.

1. At the beginning of Article 34 of the Convention, the following shall be inserted:
"Subject to the provisions of Article 29 . . ."
2. At the end of the same Article, the sentence "the Sub-Commission shall take its decisions by a majority ot its members" shall be deleted.
Article 4
1. This Protocol shall be open to signature by the member States of the Council of Europe, signatories to the Convention, who may become Parties to it eithör by:
(a) signature without reservation in respect of ratification or accept-ance, or
(b) signature with reservation in respect of ratification or acceptance, follovved by ratification or acceptance.
Instruments of ratification or acceptance shall be deposited with the Secretary-General of the Council of Europe.
2. This Protocol shall enter into force as soon as all Statos Parties to the Convention shall have become Parties to the Protocol, in aecordance with the provisions of paragraph 1 of this Article.
3. The Secrotary-CoiKMdl of the Council of Europe shall notify the member States of the Council of:
(a) any signature without reservation in respect of ratification or acceptance;
(b) any signature with reservation in respect of ratification or acceptance;
(c) the deposit of any instrument of ratification or acceptance;
(d) the date of entry into force of this Protocol in aecordance with paragraph 2 of this Article.
IN W1TNESS WHEREOF, the under-signed, being duly authorised thereto, have signed this Protocol.
DONE at Strasbourg, this 6th day of May 1963, in English and in French, both texts being equally authoritative, in a Single copy which shall remain deposited in the archives of the Council of Europe. The Secretary-General shall transmit certified copies to each of the signatory States,

Artikel 3
(1) Artikel 34 der Konvention beginnt wie folgt:
"Vorbehaltlich der Bestimmungen des Artikels 29 trifft die Kommission ..."
(2) Am Schluß desselben Artikels wird der Satz "die Unterkommission trilft ihre Entscheidungen mit Stimmenmehrheit ihrer Mitglieder" gestrichen.
Artikel 4
(1) Dieses Protokoll liegt für die Mitgliedstaaten des Europarats, welche die Konvention unterzeichnet haben, zur Unterzeichnung auf; sie können Vertragsparteien dos Protokolls werden,
a) indem sie es ohne Vorbehalt der Ratifikation oder Annahme unterzeichnen oder
b) indem sie es unter dem Voibehalt der Ratifikation oder Annahme unterzeichnen und später ratifizieren oder annehmen.
Die Ratifikations- oder Annahme-Urkunden sind beim Generalsekretär des Europarats zu hinterlegen.
(2) Dieses Protokoll tritt in Kraft, sobald alle Vertragsstaaten der Konvention nach Absatz 1 dieses Artikels Vertragsparteien des Protokolls geworden sind.
(3) Der Generalsekretär des Europarats notifiziert den Mitgliedstaaten des Rates
a) jede Unterzeichnung, die ohne Vorbehalt der Ratifikation oder Annahme erfolgt,
b) jede Unterzeichnung, die unter dem Vorbehalt der Ratifikation oder Annahme erfolgt,
c) die Hinterlegung jeder Ratifikationsoder Annahmeurkunde,
d) den Zeitpunkt des nach Absatz 2 erfolgten Inkrafttretens dieses Protokolls.
ZU URKUND DESSEN haben die hierzu gehörig befugten Unterzeichneten dieses Protokoll unterschrieben.
GESCHEHEN zu Straßburg am 6. Mai 1963 in englischer und französischer Sprache, wobei jeder Wortlaut gleichermaßen verbindlich ist, in einer Urschrift, die im Archiv des Europarats hinterlegt wird. Der Generalsekretär übermittelt allen Unterzeichnerstaaten beglaubigte Abschriften.

THE GOVERNMENTS SIGNATORY HERETO, being Members of the Council of Europe,
CONS1DERING that certain incon-veniences have arisen in the applica-tion of the provisions of Articles 22 and 40 of the Convention for the Protection of Human Rights and Fundamental Freedoms signed at Rome on 4th November 1950 (hereinafter re-ferred to as "the Convention") relating to the length of the terms of office of the members of the European C m-mission of Human Rights (hereinafter referred to as "the Commission") and of the European Court of Human Rights (hereinafter referred to as "the Court");
CONSIDERING that it is desirable to ensure as far as possible an elec-tion every three years of one half of the members of the Commission and of one third of the members of the Court;
CONSIDERING therefore that it is desirable to amend certain provisions of the Convention,
HAVE AGREED AS FOLLOWS:
Article 1
In Article 22 of the Convention, the following two paragraphs shall be inserted after paragraph (2):
"(3) In order to ensure that, as far as possible, one half of the member-ship of the Commission shall be renewed every three years, the Committee of Ministers may decide,

Article 1er
A larticle 22 de la Convention, les deux paragraphes ci-apres sont inse-res apres le paragraphe 2:
(3) Afin dassurer dans la mesure du possible le renouvellement dune moitie de la Commission tous les trois ans, le Comite des Ministres peut, avant de proceder ä toute

DIE UNTERZEICHNETEN REGIERUNGEN, die Mitglieder des Europarats sind –
IN DER ERWÄGUNG, daß die Anwendung der Artikel 22 und 40 der am 4. November 1950 in Rom unterzeichneten Konvention zum Schutze der Menschenrechte und Grundfreiheiten (im folgenden als "Konvention" bezeichnet) Anlaß zu gewissen Schwierigkeiten bezüglich der Amtsdauer der Mitglieder der Europäischen Kommission für Menschenrechte (im folgenden als "Kommission" bezeichnet) und des Europäischen Gerichtshofes für Menschenrechte (im folgenden als "Gerichtshof" bezeichnet) gegeben hat;
IN DER ERWÄGUNG, daß es wünschenswert ist, soweit wie möglich sicherzustellen, daß die Hälfte der Mitglieder der Kommission und ein Drittel der Mitglieder des Gerichtshofes alle drei Jahre neu gewählt werden;
IN DER ERWÄGUNG, daß es daher angebracht ist, gewisse Bestimmungen der Konvention zu ändern –
HABEN FOLGENDES VEREINBART:
Artikel 1
In Artikel 22 der Konvention werden nach Absatz 2 die beiden folgenden Absätze eingefügt:
"(3) Um soweit wie möglich sicherzustellen, daß die Hälfte der Mitglieder der Kommission alle drei Jahre neu gewählt wird, kann das Ministerkomitee vor jeder späteren

A r t i c 1 e 2
In Article 22 of the Convention, the former paragraphs (3) and (4) shall become respectively paragraphs (5) and (6).
Article 3
In Article 40 of the Convention, the following two paragraphs shall be inserted after paragraph (2):
"(3) In order to ensure that, as far as possible, one third of the mem-bership of the Court shall be re-newed every three years, the Con-sultative Assembly may decide, before proceeding to any subsequent election, that the term or terms of office of one or more mcmbers to be elected shall be for a period other than nine years but not more than twelve and not less than six years.
(4) In cases where more than one term of office is involved and the Consulfative Assembly applies the preceding paragraph, the allocation of the terms of office shall be ef-fected by the drawing of lots by the See retary General immediately after the election."
Article 4
In Article 40 of the Convention, the former paragraphs (3) and (4) shall become respectively paragraphs (5) and (6).
Article 5
1. This Protocol shall be open to signature by Members of the Council of Europe, signatories to the Convention, who may become Parties to it by:
(a) signature without reservation in respect of ratification or aeeept-ance;
(b) signature with reservation in respect of ratification or aeeeptance, followed by ratification or aeeeptance.

Article 2

(4) Dans le cas ou il y a lieu de conferer phisieurs mandats et que IAssemblee Consultative fait appli-cation du paragraphe precedent, la repartition des mandats sopere sui-vant un tirage au sort effectue par le Secretaire General du Conseil de lEurope immödiatement apres lelec-tion. »
Article 4
A larticle 40 de la Convention, les paragraphes 3 et 4 deviennent respec-tivement les paragraphes 5 et 6.
Article 5
1. Le present Protocole est ouvert ä la signature des Membres du Conseil de lEurope signataires de la Convention qui peuvent y devenir Parties par:
(a) la signature sans reserve de ratification ou daeeeptation;
(b) la signature sous reserve de ratification ou daeeeptation suivie de ratification ou daeeeptation.
Wahl beschließen, daß die Amts-dauer eines oder mehrerer der zu wählenden Mitglieder nicht sechs Jahre betragen soll, wobei diese Amtsdauer jedoch weder länger als neun, noch kürzer als drei Jahre sein darf.
(4) Sind mehrere Amter zu besetzen und wendet das Ministerkomitee den Absatz 3 an, so wird die Zuteilung der Amtsdauer vom Generalsekretär des Europarats unmittelbar nach der Wahl durch das Los bestimmt."
Artikel 2
In Artikel 22 der Konvention werden aus den früheren Absätzen 3 und 4 die Absätze 5 und 6.
Artikel 3
In Artikel 40 der Konvention werden nach Absatz 2 die beiden folgenden Absätze eingefügt:
"(3) Um soweit wie möglich sicherzustellen, daß ein Drittel der Mitglieder des Gerichtshofes alle drei Jahre neu gewählt wird, kann die Beratende Versammlung vor jeder späteren Wahl beschließen, daß die Amtsdauer eines oder mehrerer der zu wählenden Mitglieder nicht neun Jahre betragen soll, wobei diese Amtsdauer jedoch weder länger als zwölf, noch kürzer als sechs Jahre sein darf.
(4) Sind mehrere Ämter zu besetzen und wendet die Beratende Versammlung den Absatz 3 an, so wird die Zuteilung der Amtsdauer vom Generalsekretär des Europa-rates unmittelbar nach der Wahl durch das Los bestimmt."
Artikel 4
In Artikel 40 der Konvention werden aus den früheren Absätzen 3 und 4 die Absätze 5 und 6.

(2) Dieses Protokoll tritt in Kraft, sobald alle Vertragsparteien der Konvention nach Absatz 1 dieses Artikels Vertragsparteien des Protokolls geworden sind.
(3) Der Generalsekretär des Europarates notifiziert den Mitgliedern des Rates
a) jede Unterzeichnung, die ohne Vorbehalt der Ratifikation oder Annahme erfolgt,
b) jede Unterzeichnung, die unter dem Vorbehalt der Ratifikation oder Annahme erfolgt,
c) die Hinterlegung jeder Ratifika-tions- (Hier Annahmeurkunde,
d) den Zeitpunkt des nach Absatz 2 erfolgenden Inkrafttretens dieses Protokolls.
ZU URKUND DESSEN haben die hierzu gehörig befugten Unterzeichneten dieses Protokoll unterschrieben.
GESCHEHEN zu Straßburg am 20. Januar 1966 in englischer und französischer Sprache, wobei jeder Wortlaut gleichermaßen verbindlich ist, in einer Urschrift, die im Archiv des Europarates hinterlegt wird. Der Generalsekretär übermittelt allen unterzeichneten Regierungen beglaubigte Absein ilton.
