Gesetz zu dem Protokoll Nr. 11 vom 11. Mai 1994 zur Konvention zum Schutze der Menschenrechte und Grundfreiheiten 578 Bundesgesetzblatt, Jahrgang 1995, Teil II Gesetz zu dem Protokoll Nr. 11 vom 11. Mai 1994 zur Konvention zum Schutze der Menschenrechte und Grundfreiheiten Vom 24. Juli 1995 Der Bundestag hat das folgende Gesetz beschlossen: Artikel 1 Dem in Straßburg am 11. Mai 1994 von der Bundesrepublik Deutschland unterzeichneten Protokoll Nr. 11 zur Konvention zum Schutze der Menschenrechte und Grundfreiheiten Ober die Umgestaltung des durch die Konvention eingeführten Kontrollmechanismus wird zugestimmt. Das Protokoll wird nachstehend mit einer amtlichen deutschen Übersetzung veröffentlicht. Artikel 2 Das Bundesministerium der Justiz kann die Konvention zum Schutze der Menschenrechte und Grundfreiheiten in der durch das Protokoll Nr. 11 geänderten Fassung mit einer sprachlich überarbeiteten deutschen Übersetzung bekanntmachen. Artikel 3 (1) Dieses Gesetz tritt am Tage nach seiner Verkündung in Kraft. (2) Der Tag, an dem das Protokoll Nr. 11 nach seinem Artikel 4 für die Bundesrepublik Deutschland in Kraft tritt, ist im Bundesgesetzblatt bekanntzugeben. Die verfassungsmäßigen Rechte des Bundesrates sind gewahrt. Das vorstehende Gesetz wird hiermit ausgefertigt und wird im Bundesgesetzblatt verkündet. Berlin, den 24. November 1950 in Rom unterzeichneten Konvention zum Schutze der Menschenrechte und Grundfreiheiten (im folgenden als "Konvention" bezeichnet) unterzeichnen - in der Erwägung, daß es dringend erforderlich ist, den durch die Konvention eingeführten Kontronmechanismus umzugestalten, um die Wirksamkeit des Schutzes der Menschenrechte und Grundfreiheiten durch die Konvention insbesondere in Anbetracht der Zunahme der Beschwerden und der wachsenden Zahl der Europaratsmitglieder zu wahren und zu verbessern, in der Erwägung, daß es daher wünschenswert ist, einige Bestimmungen der Konvention zu andern, um insbesondere die bestehende Europäische Kommission für Menschenrechte und den bestehenden Europaischen Gerichtshof für Menschenrechte durch einen neuen ständigen Gerichtshof zu ersetzen, im Hinblick auf die Entschließung Nr. 1, die auf der in Wien am 19. und 20. März 1985 abgehaltenen Europäischen Ministerkonferenz über Menschenrechte angenommen wurde, im Hinblick auf die Empfehlung 1194 (1992) der Parlamentarischen Versammlung des Europarats vom 6. Oktober 1992, im Hinblick auf den von den Staats- und Regierungschefs der Mitgliedstaaten des Europarats in der Wiener Erklärung vom 9. It shall function on a permanent basis. Article 20 Number of judges The Court shall consist of a number of judges equal to that of the High Contracting Parties. Article 19 Institution de la Cour Afin dassurer le respect des engage-ments resultant pour les Hautes Parties contractantes de la presente Convention et de ses protocoles, il est Jnstftuö une Cour europeenne des Droits de lHomme, ci-des-sous nommee «la Cour». Elle fonctionne de facon permanente. Article 20 Nombre de juges La Cour se compose dun nombre de juges egal ä celui des Hautes Parties contractantes. Artikel 19 Errichtung des Gerichtshofs Um die Einhaltung der Verpflichtungen sicherzustellen, welche die Hohen Vertragschließenden Teile in dieser Konvention und den Protokollen dazu übernommen haben, wird ein Europaischer Gerichtshof für Menschenrechte, im folgenden als "Gerichtshof bezeichnet, errichtet. Er nimmt seine Aufgaben als ständiger Gerichtshof wahr. Artikel 20 Zahl der Richter Die Zahl der Richter des Gerichtshofs entspricht derjenigen der Hohen Vertragschließenden Teile. Article 21 Criteria for Office 1 The judges shall be of high moral character and must either possess the qualifications required for appointment to high judiciai Office or be jurisconsults of recognised competence. 2 The judges shall sit on the Court in their individual capacity. 3 During their term of Office the judges shall not engage in any activfty which is incompatible with their independence, im-partiality or with the demands of a full-time Office; all questions arising from the applica-tion of this paragraph shall be decided by the Court. Article 21 Conditions dexercice des fonctions 1 Les juges dofvent jouir de la plus haute conskieration morale et reunir les conditions requises pour lexercice de hautes fonctions judiciaires ou etre des jurisconsul-tes possedant une competence notoire. 2 Les juges siegent ä la Cour ä titre individuel. 3 Pendant la duree de leur mandat, les juges ne peuvent exercer aucune activitö incompatible avec les exigences dinde-pendance, dimpartialrte ou de disponibilitö requise par une activite exercee ä plein temps; toute question soulev6e en applica-tion de ce paragraphe est tranchee par la Cour. Artikel 21 Voraussetzungen für das Amt (1) Die Richter müssen hohes sittliches Ansehen genießen und entweder die für die Ausübung hoher richterlicher Amter erforderlichen Voraussetzungen erfüllen oder Rechtsgelehrte von anerkanntem Ruf sein. (2) Die Richter gehören dem Gerichtshof in ihrer persönlichen Eigenschaft an. (3) Während ihrer Amtszeit dürfen die Richter keine Tätigkeit ausüben, die mit ihrer Unabhängigkeit, ihrer Unparteilichkeit oder mit den Erfordernissen der Vollzeitbeschäftigung in diesem Amt unvereinbar ist; alle Fragen, die sich aus der Anwendung dieses Absatzes ergeben, werden vom Gerichtshof entschieden. Article 22 Election of judges 1 The judges shall be elected by the Pariiamentary Assembly with respect to each High Contracting Party by a majority of votes cast from a list of three candidates nominated by the High Contracting Party. 2 The same procedura shall be followed te complete the Court in the event of the accession of new High Contracting Parties and in filling casual vacancies. Article 22 Election des juges 1 Les juges sont elus par lAssemblee parlementaire au titre de chaque Haute Partie contractante, ä la majorite des voix ex-primees, sur une liste de trois candidats presentes par la Haute Partie contractante. 2 La meme procedura est suivie pour complöter la Cour en cas dadhesion de nouvelles Hautes Parties contractantes et pourvoir les Sieges devenus vacants. Artikel 22 Wahl der Richter (1) Die Richter werden von der Parlamentarischen Versammlung für jeden Hohen Vertragschließenden Teil mit Stimmenmehrheit aus einer Liste von drei Kandidaten gewählt, die von dem Hohen Vertragschließenden Teil vorgeschlagen werden. (2) Dasselbe Verfahren wird angewendet, um den Gerichtshof im Fall des Beitritts neuer Hoher Vertragschließender Teile zu ergänzen und um freigewordene Sitze zu besetzen. Nr. 22 - Tag der Ausgabe: Bonn, den 29. Juli 1995 581 Article 23 Terms of Office 1 The judges shall be elected for a period of six years. They may be re-elected. How-ever, the terms of Office of one-half of the judges elected at the first election shall ex-pire at the end of three years. 2 The judges whose terms of Office are to expire at the end of the initial period of three years shall be chosen by lot by the Secret-ary General of the Council of Europe imme-diately after their election. 3 In order to ensure that, as far as pos-sible, the terms of Office of one-half of the judges are renewed every three years, the Pariiamentary Assembly may decide, be-fore proceeding to any subsequent election, that the term or terms of Office of one or more judges to be elected shall be for a period other than six years but not more than nine and not less than three years. 4 In cases where more than one term of Office is invotved and where the Pariiamentary Assembly applies the preceding Paragraph, the allocation of the terms of Office shall be effected by a drawing of lots by the Secretary General of the Council of Europe immediately after the election. 5 A judge elected to replace a judge whose term of Office has not expired shall hold Office for the remainder of his prede-cessor*s term. 6 The terms of Office of judges shall expire when they reach the age of 70. 7 The judges shall hold Office until re-placed. They shall, however, continue to deal with such cases as they already have under consideration. Article 24 Dismissal No judge may be dismissed from his Office unless the other judges decide by a majority of two-thirds that he has ceased to furfil the required conditions. Article 25 Registry and legal secretaries The Court shall have a registry, the func-tions and Organisation of which shall be laid down in the rules of the Court. The Court shall be assisted by legal secretaries. Article 26 Plenary Court The plenary Court shall a elect its President and one or two Vice-Presidents for a period of three years; they may be re-elected; b set up Chambers, constituted for a fixed period of time; Article 23 Duree du mandat 1 Les juges sont elus pour une duree de six ans. Toutefois, les mandats dune moitie des juges designes tors de la premiere election prendront fin au bout de trois ans. 2 Les juges dont le mandat prendra fin au terme de la periode initiale de trois ans sont designös par tirage au sort effectue par le Secr6taire G6n6ral du Conseil de lEuro-pe, immediatement apres leur election. 3 Afin dassurer, dans la mesure du possible, le renouvellement des mandats dune moitie des juges tous les trois ans, lAssemblee pariementaire peut, avant de procäder ä toute Election ulterieure, decider quun ou plusieurs mandats des juges ä elire auront une duree autre que celle de six ans, sans quelle puisse toutefois exender neuf ans ou etre inferieure ä trois ans. 4 Dans le cas oü il y a lieu de conferer plusieurs mandats et oü lAssemblee pariementaire fait application du paragraphe precedent, la repartition des mandats sopere suivant un tirage au sort effectu6 par le Secretaire General du Conseil de lEurope immödiatement apres lelection. 5 Le juge elu en remplacement dun juge dont le mandat nest pas expire acheve le mandat de son predecesseur. 6 Le mandat des juges saeheve des quils atteignent Tage de 70 ans. 7 Les juges restent en fonetions jusquä leur remplacement. Ils continuent toutefois de connaitre des affaires dont ils sont dejä saisis. Article 24 Revocation Un juge ne peut etre relevä de ses fonetions que si les autres juges döcident, ä la majorite des deux tiers, quil a cessö de röpondre aux conditions requises. Article 25 Greffe et referendaires La Cour dispose dun greffe dont les täches et lorganisation sont fixees par le reglement de la Cour. Elle est assistee de reförendaires. Article 26 Assembler planiere de la Cour La Cour reunie en Assemblee planiere a elit, pour une duree de trois ans, son President et un ou deux vice-presidents; ils sont reeligibles; b constitue des Chambres pour une Periode determinee; Artikel 23 Amtszeit (1) Die Richter werden für sechs Jahre gewählt. Ihre Wiederwahl ist zulässig. Jedoch endet die Amtszeit der Hälfte der bei der ersten Wahl gewählten Richter nach drei Jahren. (2) Die Richter, deren Amtszeit nach drei Jahren endet, werden unmittelbar nach ihrer Wahl vom Generalsekretär des Europarats durch das Los bestimmt. (3) Um soweit wie möglich sicherzustellen, daß die Hälfte der Richter alle drei Jahre neu gewählt wird, kann die Parlamentarische Versammlung vor jeder späteren Wahl beschließen, daß die Amtszeit eines oder mehrerer der zu wählenden Richter nicht sechs Jahre betragen soll, wobei diese Amtszeit weder länger als neun noch kürzer als drei Jahre sein darf. (4) Sind mehrere Ämter zu besetzen und wendet die Parlamentarische Versammlung Absatz 3 an, so wird die Zuteilung der Amtszeiten vom Generalsekretär des Europarats unmittelbar nach der Wahl durch das Los bestimmt. (5) Ein Richter, der anstelle eines Richters gewählt wird, dessen Amtszeit noch nicht abgelaufen ist, übt sein Amt für die restliche Amtszeit seines Vorgängers aus. (6) Die Amtszeit der Richter endet mit Vollendung des 70. Lebensjahrs. (7) Die Richter bleiben bis zum Amtsantritt ihrer Nachfolger im Amt. Sie bleiben jedoch in den Rechtssachen tätig, mit denen sie bereits befaßt sind. Artikel 24 Entlassung Ein Richter kann nur entlassen werden, wenn die anderen Richter mit Zweidrittelmehrheit entscheiden, daß er die erforderlichen Voraussetzungen nicht mehr erfüllt. Artikel 25 Kanzlei und wissenschaftliche Mitarbeiter Der Gerichtshof hat eine Kanzlei, deren Aufgaben und Organisation in der Verfahrensordnung des Gerichtshofs festgelegt werden. Der Gerichtshof wird durch wissenschaftliche Mitarbeiter unterstützt. Artikel 26 Plenum des Gerichtshofs Das Plenum des Gerichtshofs a) wählt seinen Präsidenten und einen oder zwei Vizepräsidenten für drei Jahre; ihre Wiederwahl ist zulässig, b) bildet Kammern für einen bestimmten Zeitraum, 582 Bundesgesetzblatt, Jahrgang 1995, Teil II c elect the Presidents of the Chambers of the Court; they may be re-elected; d adopt the rules of the Court; and e elect the Registrar and one or more De-puty Registrars. Article 27 Committees, Chambers and Grand Chamber 1 To consider cases brought before it, the Court shall sit in committees of three judges, in Chambers of seven judges and in a Grand Chamber of seventeen judges. The Courts Chambers shall set up committees for a fixed period of time. 2 There shall sit as an ex officio member of the Chamber and the Grand Chamber the judge elected in respect of the State Party concemed or, if there is none or if he is unable to sit, a person of its choice who shall sit in the capacity of judge. 3 The Grand Chamber shall also include the President of the Court, the Vice-Presi-dents, the Presidents of the Chambers and other judges chosen in accordance with the rules of the Court. When a case is referred to the Grand Chamber under Article 43, no judge from the Chamber which rendered the judgment shall sit in the Grand Chamber, with the exception of the President of the Chamber and the judge who sat in respect of the State Party concemed. Article 28 Declarations of inadmissibility by committees A committee may, by a unanimous vote, declare inadmissible or strike out of its list of cases an individual application submitted under Article 34 where such a decision can be taken without further examination. The decision shall be final. Article 29 Decisions by Chambers on admissibility and merits 1 If no decision is taken under Article 28, a Chamber shall decide on the admissibility and merits of individual applications submitted under Article 34. 2 A Chamber shall decide on the admissibility and merits of inter-State applications submitted under Article 33. 3 The decision on admissibility shall be taken separater/ unless the Court, in excep-tional cases, decides otherwise. c eiit les presidents des Chambres de la Cour, qui sont reeiigibles; d adopte le reglement de la Cour; et e 6lit le greffier et un ou plusieurs greffiers adjoints. Article 27 Comites, Chambres et Grande Chambre 1 Pour lexamen des affaires portöes de-vant eile, la Cour siege en comites de trois juges, en Chambres de sept juges et en une Grande Chambre de dix-sept juges. Les Chambres de la Cour constituent les comites pour une p6riode determinee. 2 Le juge 6lu au titre dun Etat partie au litige est membre de droit de la Chambre et de la Grande Chambre; en cas dabsence de ce juge, ou lorsquil nest pas en mesure de Sieger, cet Etat partie designe une personne qui siege en qualite de juge. 3 Font aussi partie de la Grande Chambre le prösident de la Cour, les vice-presi-dents, les presidents des Chambres et dau-tres juges dösignes conformement au reglement de la Cour. Quand laffaire est d6f6ree ä la Grande Chambre en vertu de lar-ticle 43, aucun juge de la Chambre qui a rendu larret ne peut y Sieger, ä lexception du President de la Chambre et du juge ayant si6g6 au titre de PEtat partie interes- se. Article 28 Declarations dirrecevabilite par les comites Un comite peut, par vote unanime, d6cla-rer irrecevable ou rayer du röle une requöte individuelle introduite en vertu de larticle 34 lorsquune teile decision peut eire prise sans examen compiementaire. La decision est definitive. Article 29 Decisions des Chambres sur la recevabilite et le fond 1 Si aucune decision na 6t6 prise en vertu de larticle 28, une Chambre se pro-nonce sur la recevabilite et le fond des requ&tes individuelles introduites en vertu de larticle 34. 2 Une Chambre se prononce sur la recevabilite et le fond des requötes 6tatiques introduites en vertu de larticle 33. 3 Sauf decision contraire de la Cour dans des cas exceptionnels, la decision sur la recevabilite est prise separement. c) wählt die Präsidenten der Kammern des Gerichtshofs; ihre Wiederwahl ist zulässig, d) beschließt die Verfahrensordnung des Gerichtshofs und e) wählt den Kanzler und einen oder mehrere stellvertretende Kanzler. Artikel 27 Ausschüsse, Kammern und Große Kammer (1) Zur Prüfung der Rechtssachen, die bei ihm anhängig gemacht werden, tagt der Gerichtshof in Ausschüssen mit drei Richtern, in Kammern mit sieben Richtern und in einer Großen Kammer mit siebzehn Richtern. Die Kammern des Gerichtshofs bilden die Ausschüsse für einen bestimmten Zeitraum. (2) Der Kammer und der Großen Kammer gehört von Amts wegen der für den als Partei beteiligten Staat gewählte Richter oder, wenn ein solcher nicht vorhanden ist oder er an den Sitzungen nicht teilnehmen kann, eine von diesem Staat benannte Person an, die in der Eigenschaft eines Richters an den Sitzungen teilnimmt. (3) Der Großen Kammer gehören femer der Präsident des Gerichtshofs, die Vizepräsidenten, die Präsidenten der Kammern und andere nach der Verfahrensordnung des Gerichtshofs ausgewählte Richter an. Wird eine Rechtsache nach Artikel 43 an die Große Kammer verwiesen, so dürfen Richter der Kammer, die das Urteil gefällt hat, der Großen Kammer nicht angehören; das gilt nicht für den Präsidenten der Kammer und den Richter, welcher in der Kammer für den als Partei beteiligten Staat mitgewirkt hat. Artikel 28 Unzulässigkeitserklärungen der Ausschüsse Ein Ausschuß kann durch einstimmigen Beschluß eine nach Artikel 34 erhobene Individualbeschwerde für unzulässig erklären oder im Register streichen, wenn eine solche Entscheidung ohne weitere Prüfung getroffen werden kann. Die Entscheidung ist endgültig. Artikel 29 Entscheidungen der Kammern über die Zulässigkeit und Begründetheit (1) Ergeht keine Entscheidung nach Artikel 28, so entscheidet eine Kammer über die Zulässigkeit und Begründetheit der nach Artikel 34 erhobenen Individualbeschwerden. (2) Eine Kammer entscheidet über die Zulässigkeit und Begründetheit der nach Artikel 33 erhobenen Staatenbeschwerden. (3) Die Entscheidung über die Zulässigkeit ergeht gesondert, sofern nicht der Gerichtshof in Ausnahmefällen anders entscheidet. Nr. 22 - Tag der Ausgabe: Bonn, den 29. Juli 1995 583 Article 30 Relinquishment of Jurisdiction to the Grand Chamber Where a case pending before a Chamber raises a serious question affecting the Interpretation of the Convention or the proto-cols thereto, or where the resolution of a question before the Chamber might have a result inconsistent with a judgment previ-ously delivered by the Court, the Chamber may, at any time before it has rendered its judgment, relinquish Jurisdiction in favour of the Grand Chamber, unless one of the par-ties to the case objects. Article 31 Powers of the Grand Chamber The Grand Chamber shall a determine applications submitted either under Article 33 or Article 34 when a Chamber has relinquished Jurisdiction under Article 30 or when the case has been referred to it under Article 43; and b consider requests for advisory opinions submitted under Article 47. Article 32 Jurisdiction of the Court 1 The Jurisdiction of the Court shall ex-tend to all matters concerning the Interpretation and application of the Convention and the protocols thereto which are referred to it as provided in Articles 33, 34 and 47. 2 In the event of dispute as to whether the Court has Jurisdiction, the Court shall decide. Article 33 Inter-State cases Any High Contracting Party may refer to the Court any alleged breach of the provi-sions of the Convention and the protocols thereto by another High Contracting Party. Article 34 Individual applications The Court may receive applications from any person, non-governmental Organisation or group of individuals claiming to be the victim of a violation by one of the High Contracting Parties of the rights set forth in the Convention or the protocols thereto. The High Contracting Parties undertake not to hinder in any way the effective exercise of this right. Artikel 32 Zuständigkeit des Gerichtshofs (1) Die Zuständigkeit des Gerichtshofs umfaßt alle die Auslegung und Anwendung dieser Konvention und der Protokolle dazu betreffenden Angelegenheiten, mit denen er nach den Artikeln 33, 34 und 47 befaßt wird. (2) Besteht Streit über die Zuständigkeit des Gerichtshofs so entscheidet der Gerichtshof. Artikel 33 Staatenbeschwerden Jeder Hohe Vertragschließende Teil kann den Gerichtshof wegen jeder behaupteten Verletzung dieser Konvention und der Protokolle dazu durch einen anderen Hohen Vertragschließenden Teil anrufen. Artikel 34 Individualbeschwerden Der Gerichtshof kann von jeder natürlichen Person, nichtstaatlichen Organisation oder Personengruppe, die behauptet, durch einen der Hohen Vertragschließenden Teile in einem der in dieser Konvention oder den Protokollen dazu anerkannten Rechte verletzt zu sein, mit einer Beschwerde befaßt werden. Die Hohen Vertragschließenden Teile verpflichten sich, die wirksame Ausübung dieses Rechts nicht zu behindern. It may do so at any stage of the proceedings. Article 36 Third-party Intervention 1 In all cases before a Chamber or the Grand Chamber, a High Contracting Party one of whose nationals is an applicant shall have the right to submit written oomments and to take part in hearings. 2 The President of the Court may, in the interest of the proper administration of justice, invite any High Contracting Party which is not a party to the proceedings or any person concemed who is not the applicant to submit written oomments or take part in hearings. Articte 37 Striking out applications 1 The Court may at any stage of the proceedings deckte to strike an application out of its list of cases where the circum-stances lead to the conclusion that a the applicant does not intend to pursue his application; or b the matter has been resofved; or c for any other reason established by the Court, it is no longer justified to continue the examination of the application. However, the Court shall continue the examination of the application if respect for human rights as defined in the Convention and the protocols thereto so requires. Artikel 36 Beteiligung Dritter (1) In alten bei einer Kammer oder der Großen Kammer anhängigen Rechtssachen ist der Hohe Vertragschließende Teil, dessen Staatsangehörigkeit der Beschwerdeführer besitzt, berechtigt, schriftliche Stellungnahmen abzugeben und an den mündlichen Verhandlungen teilzunehmen. (2) Im Interesse der Rechtspflege kann der Präsident des Gerichtshofs jedem Hohen Vertragschließenden Teil, der in dem Verfahren nicht Partei ist, oder jeder betroffenen Person, die nicht Beschwerdeführer ist, Gelegenheit geben, schriftlich Stellung zu nehmen oder an den mündlichen Verhandlungen teilzunehmen. Artikel 37 Streichung von Beschwerden (1) Der Gerichtshof kann jederzeit während des Verfahrens entscheiden, eine Beschwerde in seinem Register zu streichen, wenn die Umstände Grund zur Annahme geben, daß a) der Beschwerdeführer seine Beschwerde nicht weiterzuverfolgen beabsichtigt b) die Streitigkeit einer Lösung zugeführt worden ist oder c) eine weitere Prüfung der Beschwerde aus anderen vom Gerichtshof festgestellten Gründen nicht gerechtfertigt ist. Der Gerichtshof setzt jedoch die Prüfung der Beschwerde fort, wenn die Achtung der Menschenrechte, wie sie in dieser Konvention und den Protokollen dazu anerkannt sind, dies erfordert. Article 38 Examination of the case and friendty setttement proceecfmgs 1 If the Court declares the appiication admissible, it shail a pursue the examination of the case, together with the representatives of the parties, and if need be, undertake an investigation, for the effective conduct of which the States concerned shall furnish all necessary facilities; b place itsetf at the disposal of the parties concerned with a view to securing a friendly settJement of the matter on the basis of respect for human rights as de-fined in the Convention and the protocols thereto. 2 Proceedings conducted under Paragraph 1.b shall be confidential. Article 39 Finding of a friendly settiement ff a friendty settiement is effected, the Court shall strike the case out of its list by means of a decision which shall be confined to a brief Statement of the facts and of the Solution reached. Article 40 Public hearings and access to documents 1 Hearings shall be public unless the Court in exceptional circumstances decides otherwise. 2 Documents deposited with the Regis-trar shall be accessible to the public unless the President of the Court decides otherwise. Article 41 Just satisfaction If the Court finds that there has been a violation of the Convention or the protocols thereto, and if the internal law of the High Contracting Party concerned allows only partial reparatton to be made, the Court shall, if necessary, afford just satisfaction to the injured party. Artikel 39 Gütliche Einigung Im Fall einer gütlichen Einigung streicht der Gerichtshof durch eine Entscheidung, die sich auf eine kurze Angabe des Sachverhalts und der erzielten Lösung beschränkt, die Rechtssache in seinem Register. Artikel 40 öffentliche Verhandlung und Akteneinsicht (1) Die Verhandlung ist öffentlich, soweit nicht der Gerichtshof auf Grund besonderer Umstände anders entscheidet. Article 45 Reasons for judgments and decisions 1 Reasons shall be given for judgments as well as for decisions declaring applica-tions admissible or inadmissible. 2 If a judgment does not represent, in whole or in-part, the unanimous opinion of the judges, any judge shall be entitled to deliver a separate opinion. Article 46 Binding force and execution of judgments 1 The High Contracting Parties under-take to abide by the final judgment of the Court in any case to which they are parties. 2 The final judgment of the Court shall be transmitted to the Committee of Ministers, which shall supervise its execution. (2) Das Urteil einer Kammer wird endgültig, a) wenn die Parteien erklären, daß sie die Verweisung der Rechtssache an die Große Kammer nicht beantragen werden, b) drei Monate nach dem Datum des Urteils, wenn nicht die Verweisung der Rechtssache an die Große Kammer beantragt worden ist, oder c) wenn der Ausschuß der Großen Kammer den Antrag auf Verweisung nach Artikel 43 abgelehnt hat. (3) Das endgültige Urteil wird veröffentlicht. Artikel 45 Begründung der Urteile und Entscheidungen (1) Urteile sowie Entscheidungen, mit denen Beschwerden für zulässig oder für unzulässig erklärt werden, werden begründet. (2) Bringt ein Urteil ganz oder teilweise nicht die übereinstimmende Meinung der Richter zum Ausdruck, so ist jeder Richter berechtigt, seine abweichende Meinung darzulegen. Artikel 46 Verbindlichkeit und Durchführung*) der Urteile (1) Die Hohen Vertragschließenden Teile verpflichten sich, in allen Rechtssachen, in denen sie Partei sind, das endgültige Urteil des Gerichtshofs zu befolgen. Juli 1995 587 Article47 Advisory opinions 1 The Court may, at the request of the Committee of Ministers, give advisory opinions on legal questions concerning the Interpretation of the Convention and the pro-tocols thereto. 2 Such opinions shall not deal with any question relating to the content or scope of the rights or freedoms defined in Section I of the Convention and the protocols thereto, or with any other question which the Court or the Committee of Ministers might have to consider in consequence of any such pro-ceedings as could be instituted in accord-ance with the Convention. 3 Decisions of the Committee of Ministers to request an advisory opinion of the Court shafl require a majority vote of the representatives entitled to Sit on the Committee. Article4d Advisory Jurisdiction of the Court The Court shall decide whether a request for an advisory opinion submitted by the Committee of Ministers is within its compet-ence as defined in Article 47. Article 49 Reasons for advisory opinions 1 Reasons shall be given for advisory opinions of the Court. 2 If the advisory opinion does not re-present, in whote or in part, the unanimous opinion of the judges, any judge shall be entitled to deliver a separate opinion. 3 Advisary opinions of the Court shall be communicated to the Committee of Ministers. Article 50 Expenditure on the Court The expenditure on the Court shall be borne by the Council of Europe. Article 51 Privileges and immunities of judges The judges shall be entitled, during the exercise of their functions, to the Privileges and immunities provided for in Article 40 of the Statute of the Council of Europe and in the agreements made thereunder." Artikel 49 Begründung der Gutachten (1) Die Gutachten des Gerichtshofs werden begründet. Article 4 This Protocol shall enter into force on the first day of the month following the expira-tion of a period of one year after the date on which all Parties to the Convention have expressed their consent to be bound by the Protocol in accordance with the provisions of Article 3. The election of new judges may take place, and any further necessary steps may be taken to establish the new Court, in accordance with the provisions of this Protocol from the date on which all Parties to the Convention have expressed their consent to be bound by the Protocol. (2) Die Ratifikations-, Annahme- oder Genehmigungsurkunden werden beim Generalsekretär des Europarats hinterlegt. Artikel 4 Dieses Protokoll tritt am ersten Tag des Monats in Kraft, der auf einen Zeitabschnitt von einem Jahr nach dem Tag folgt, an dem alle Vertragsparteien der Konvention nach Artikel 3 ihre Zustimmung ausgedrückt haben, durch das Protokoll gebunden zu sein. Cases not referred to the Court shall be dealt with by the Committee of Ministers acting in accordance with the provisions of former Article 32 of the Convention. 5 Cases pending betöre the Court which have not been decided at the date of entry into force of this Protocol shall be transmitted to the Grand Chamber of the Court, which shall examine them in accordance with the provisions of this Protocol. 6 Cases pending betöre the Committee of Ministers which have not been decided under former Article 32 of the Convention at the date of entry into force of this Protocol shall be completed by the Committee of Ministers acting in accordance with that Article. Article 6 Where a High Contracting Party had made a declaration recognising the compet-ence of the Commission or the Jurisdiction of the Court under former Article 25 or 46 of the Convention with respect to matters aris-ing after or based on facts occurring subse-quent to any such declaration, this Umttation shall remain vaüd for the Jurisdiction of the Court under this Protocol. (4) Bei Beschwerden, zu denen die Kommission nach Inkrafttreten dieses Protokolls nach dem bisherigen Artikel 31 der Konvention einen Bericht angenommen hat, wird der Bericht den Parteien übermittelt, die nicht das Recht haben, ihn zu veröffentlichen. Die Rechtssache kann nach den vor Inkrafttreten dieses Protokolls geltenden Bestimmungen dem Gerichtshof vorgelegt werden. Der Ausschuß der Großen Kammer bestimmt, ob eine der Kammern oder die Große Kammer die Sache entscheidet Wird die Sache von einer Kammer entschieden, so ist ihre Entscheidung endgültig. Sachen, die nicht dem Gerichtshof vorgelegt werden, behandelt das Ministerkomitee nach dem bisherigen Artikel 32 der Konvention. (5) Beim Gerichtshof anhängige Rechtssachen, die bis zum Tag des Inkrafttretens dieses Protokolls noch nicht entschieden sind, werden der Großen Kammer des Gerichtshofs vorgelegt; diese prüft sie nach Maßgabe dieses Protokolls. (6) Beim Ministerkomitee anhängige Rechtssachen, die bis zum Tag des Inkrafttretens dieses Protokolls noch nicht nach dem bisherigen Artikel 32 der Konvention entschieden sind, werden vom Ministerkomitee nach jenem Artikel abgeschlossen. Artikel 6 Hat ein Hoher Vertragschließender Teil eine Erklärung abgegeben, mit der er nach den bisherigen Artikeln 25 oder 46 der Konvention die Zuständigkeit der Kommission oder die Gerichtsbarkeit des Gerichtshofs nur für Angelegenheiten anerkennt die sich nach dieser Erklärung ergeben oder auf Sachverhalten beruhen, die nach dieser Erklärung eintreten, so bleibt diese Beschränkung für die Gerichtsbarkeit des Gerichtshofs nach diesem Protokoll gültig.
