Bekanntmachung über das Inkrafttreten des Protokolls Nr. 14 vom 13. Mai 2004 zur Konvention zum Schutz der Menschenrechte und Grundfreiheiten über die Änderung des Kontrollsystems der Konvention

I. Nach Artikel 3 Absatz 2 des Gesetzes vom 21. Februar 2006 zu dem Protokoll Nr. 14 vom 13. Mai 2004 zur Konvention zum Schutz der Menschenrechte und Grundfreiheiten über die Änderung des Kontrollsystems der Konvention (BGBl. 2006 II S. 138, 139) wird bekannt gemacht, dass das Protokoll nach seinem Artikel 19 für die Bundesrepublik Deutschland am 1. Juni 2010 in Kraft getreten ist; die Ratifikationsurkunde war am 11. April 2006 beim Generalsekretär des Europarats hinterlegt worden. Das Protokoll ist ferner für folgende weitere Staaten am 8. Juli 2010 in Kraft getreten: Albanien Andorra Armenien Aserbaidschan Belgien Bosnien und Herzegowina Bulgarien Dänemark Estland Finnland Frankreich Georgien Griechenland Irland Island Italien Kroatien Lettland Liechtenstein Litauen Luxemburg Malta Mazedonien, ehemalige jugoslawische Republik Moldau Monaco Montenegro Niederlande Norwegen Österreich Polen Portugal Rumänien Russische Föderation nach Maßgabe der unter II. abgedruckten Erklärung San Marino Schweden Schweiz Serbien Slowakei Slowenien Spanien Tschechische Republik Türkei Ukraine Ungarn Vereinigtes Königreich Zypern.

(Übersetzung) "The Russian Federation declares that: - the Protocol will be applied in accordance with the understanding contained in the Declaration on "Ensuring the effectiveness of the implementation of the European Convention on Human Rights at national and European levels" adopted by the Committee of Ministers of the Council of Europe at its 114th session on 12 May 2004; - the provisions of the Protocol and their application will be without prejudice to further steps aimed at reaching a full consensus between Member States of the Council of Europe on issues of strengthening the control mechanism of the Convention for the Protection of Human Rights and Fundamental Freedoms and of the European Court of Human Rights, including elaboration of a new additional protocol to the Convention based on the proposals of the "Group of Wise Persons" established to consider the issue of the long-term effectiveness of the Convention control mechanism; - the application of the Protocol will be without prejudice to the process of improving the modalities of functioning of the European Court of Human Rights, first of all to strengthening the stability of its Rules, not excluding supplementary measures to be adopted by the Committee of Ministers of the Council of Europe aimed at reinforcing the control over the use of financial means allocated to the European Court of Human Rights and at ensuring the quality of staff of its Registry, with the understanding that procedural rules relating to examination of applications by the European Court of Human Rights must be adopted in the form of an international treaty subject to ratification or to another form of expression by a State of its consent to be bound by its provisions. ,,Die Russische Föderation erklärt, dass - das Protokoll im Einklang mit dem Inhalt der vom Ministerkomitee des Europarats auf seiner 114. Tagung am 12. Mai 2004 angenommenen Erklärung über die ,,Gewährleistung der Wirksamkeit der Umsetzung der Europäischen Menschenrechtskonvention auf nationaler und europäischer Ebene" Anwendung finden wird; - das Protokoll und seine Anwendung keinen Einfluss haben wird auf weitere Schritte zur Erzielung vollständigen Einvernehmens zwischen den Mitgliedstaaten des Europarats über Fragen der Stärkung des Kontrollmechanismus der Konvention zum Schutz der Menschenrechte und Grundfreiheiten und des Europäischen Gerichtshofs für Menschenrechte, einschließlich der Ausarbeitung eines weiteren Zusatzprotokolls zur Konvention auf der Grundlage der Vorschläge der ,,Gruppe der Weisen", die gebildet wurde, um die Frage der langfristigen Wirksamkeit des Kontrollmechanismus der Konvention zu erörtern; - die Anwendung des Protokolls keinen Einfluss haben wird auf den Prozess der Verbesserung der Funktionsweisen des Europäischen Gerichtshofs für Menschenrechte, vor allem nicht auf die Stärkung der Stabilität seiner Verfahrensordnung, wobei zusätzliche vom Ministerkomitee des Europarats zu beschließende Maßnahmen zur Stärkung der Kontrolle der dem Europäischen Gerichtshof für Menschenrechte zugewiesenen Geldmittel und der Sicherstellung der Eignung der Mitarbeiter seiner Kanzlei nicht ausgeschlossen sind; hierbei wird davon ausgegangen, dass Verfahrensregeln in Bezug auf die Prüfung von Beschwerden durch den Europäischen Gerichtshof für Menschenrechte in Form eines völkerrechtlichen Vertrags zu beschließen sind, der der Ratifikation bedarf oder eines anderen Ausdrucks der Zustimmung eines Staates, durch ihn gebunden zu sein; - die Anwendung des Artikels 28 Absatz 3 der Konvention in der durch Artikel 8 des Protokolls geänderten Fassung nicht das Recht einer beteiligten Hohen Vertragspartei ausschließt, im Fall, dass der für sie gewählte Richter nicht Mitglied des Ausschusses ist, zu beantragen, dass dieser den Sitz eines Mitglieds im Ausschuss einnehmen kann; - keine Bestimmung des Protokolls vor dessen Inkrafttreten nach Artikel 19 Anwendung findet."

- The Russian Federation declares that the application of Article 28, paragraph 3 of the Convention as amended by Article 8 of the Protocol does not exclude the right of a High Contracting Party concerned, if the judge elected in its respect is not a member of the committee, to request that he or she be given the possibility to take the place of one of the members of the committee. - The Russian Federation declares that no provision of the Protocol will be applied prior to its entry into force in accordance with Article 19."
